Terms of Sevice for Businesses

These Terms govern participation in FunDay (funday.site) by businesses, service providers, and partners (“Partners”).
By creating a partner account, subscribing to a plan, or submitting experiences, you agree to these Terms.
1. Description of the Platform
FunDay is a family travel platform that helps partners present experiences through smart itineraries, partner pages, and promotional features. FunDay facilitates discovery and engagement but does not provide the underlying travel services offered by Partners.
Partners remain fully responsible for their services.
2. Partner Accounts
You must provide accurate business information and maintain its accuracy.
You are responsible for:

Compliance with laws

Customer communication
-
Service fulfillment
We may suspend accounts that violate these Terms.
3. Publishing Experiences
Partners may submit experiences, descriptions, media, pricing references, and booking links.
You must have rights to all content you upload.
FunDay may edit formatting, presentation, and placement to maintain platform quality.
4. Partner Content License
By submitting content to FunDay, you grant FunQuest LLC a worldwide, non-exclusive, royalty-free license to:

Create partner pages

Feature content in promotional materials

Adapt content for different formats
-
Use content within recommendation and matching systems

Enable embedding or linking of itineraries on third-party websites
-
Reuse content across multiple itineraries, destinations, editorial features, and future platform formats
This license is limited to operating, improving, and promoting the Service.
You retain ownership of your content.
Partner content and pages may remain active on the platform after subscription cancellation unless the Partner explicitly requests removal in writing.
5. Smart Itinerary Participation
FunDay may include partner experiences within itineraries based on destination context, family preferences, and platform insights.
Inclusion is not guaranteed.
FunDay determines placement, presentation, and visibility.
6. Performance Disclaimer
FunDay does not guarantee bookings, traffic levels, revenue, or specific performance outcomes. Visibility may vary based on destination demand, platform changes, editorial decisions, and subscription level.
7. Placement and Recommendation Flexibility
FunDay determines how, when, and whether partner experiences appear within itineraries, recommendations, and promotional content. Placement may change over time and may be influenced by platform insights, family preferences, and editorial considerations.
8. Smart Itinerary Functionality
FunDay’s smart itineraries are generated using a combination of algorithmic recommendations, editorial curation, partner-provided information, platform insights, and data from publicly available or third-party sources.
These systems are designed to help families understand how partner experiences may fit within a broader travel plan and to provide contextual inspiration around destinations and activities.
As with any automated or data-driven system:

Information may be incomplete, inaccurate, or outdated

Third-party data may contain errors or changes outside FunDay’s control

Placement, sequencing, and recommendations may evolve over time

Experiences displayed alongside a partner’s offering may change dynamically
While FunDay makes reasonable efforts to review, improve, and refine itinerary quality, we do not guarantee that itinerary content is complete, current, or error-free, and we are not responsible for inaccuracies originating from third-party sources.
Smart itineraries are intended as planning guidance and discovery tools rather than definitive travel plans. A user’s decision not to book an activity after viewing an itinerary does not constitute a failure of the Service.
FunDay does not guarantee booking outcomes, conversion performance, visibility levels, or business results associated with itinerary inclusion or display.
FunDay may automatically modify itinerary components, including replacing or reordering activities, to better match family preferences, platform insights, or destination context.
9. Partner Pages and Embeds
Partners may receive dedicated experience or itinerary pages and may embed or link itineraries on their own websites.
Partners are responsible for implementation of embedded itineraries on their sites and for compliance with applicable privacy, cookie, and disclosure requirements.
10. Promotions and Campaigns
FunDay may feature partners through campaigns, seasonal highlights, destination initiatives, or platform content.
Participation and visibility may vary by subscription level and editorial decisions.
Participation does not grant exclusivity unless explicitly agreed in writing.
11. Analytics and Platform Insights
FunDay may provide aggregated engagement insights related to itineraries, experiences, or audience behavior.
These insights:

Do not include personal user data

Reflect platform activity

May change as features evolve
FunDay retains all rights to aggregated data, platform insights, recommendation logic, and analytics derived from platform activity.
12. Subscriptions and Payments
Some features require an active subscription.
Partners agree to:

FunDay may modify pricing or features with notice.
13. Acceptable Use
Partners may not:

Violations may result in removal or termination.
14. Partner Responsibility for Services
Partners are solely responsible for:

Disputes
FunDay is not a party to transactions between Partners and families.
15. Content Moderation
FunDay may edit, reposition, or remove partner content to maintain quality, accuracy, or platform integrity.
We are not obligated to publish all submitted content.
16. Platform Role Disclaimer
FunDay is not a travel agency, booking provider, or service operator unless explicitly stated.
FunDay provides discovery, planning tools, and promotional infrastructure.
17. Intellectual Property
FunDay retains ownership of:

Matching systems

Aggregated insights

Editorial presentation
Partners retain ownership of submitted content while granting operational usage rights.
18. Limitation of Liability
FunQuest LLC is not liable for:

Indirect damages
19. Indemnification
Partners are responsible for the accuracy, legality, safety, and delivery of their experiences, services, and content.
You agree to indemnify, defend, and hold harmless FunDay, FunQuest LLC, its owners, employees, affiliates, and partners from any claims, damages, liabilities, losses, costs, and expenses (including legal fees) arising from:

Your content or materials

Your services or experiences

Customer disputes or transactions
-
Any injury, incident, or safety issue related to your activities

Your violation of these Terms

Your violation of applicable laws or third-party rights
20. Termination
We may suspend or terminate participation for violations, misuse, or inactivity.
Partners may cancel subscriptions subject to plan terms.
21. Changes to the Platform
FunDay may evolve how itineraries, partner pages, analytics, subscription features, and promotional formats operate.
22. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
23. Changes to Terms
We may update these Terms. Continued participation indicates acceptance.
